ORDERS:
ORDER OF DISMISSAL
Pursuant to S.C. Code Ann. § 1-23-110(A)(3) (2005), a public
hearing on an amendment to Regulation 73-500 proposed by the South Carolina Law
Enforcement Division (“SLED”) was scheduled in the above-captioned matter for
1:00 p.m. on Wednesday, May 28, 2008, at the South Carolina Administrative Law
Court in Columbia, South Carolina. ALC Rule 45 requires an agency proposing a
regulation to provide a statement to the Court, at least ten days before the
scheduled date of the public hearing, confirming the need for a hearing on the
regulation pursuant to § 1-23-110 because a request for a hearing was made by
twenty-five persons, a governmental subdivision or agency, or an association
having not less than twenty-five members. Here, SLED advised this Court, by
letter dated May 28, 2008, that no requests for a hearing were submitted to it
regarding the proposed regulation identified above. Thus, pursuant to §
1-23-110(A)(3), it is not necessary to hold a public hearing on the proposed
regulation in this matter.
IT IS HEREBY ORDERED that the hearing on the proposed
regulation identified above and scheduled for 1:00 p.m. on Wednesday, May 28,
2008, is hereby CANCELED.
IT
IS FURTHER ORDERED that this matter is DISMISSED.
