CONSENT ORDER OF DISMISSAL

This matter is an appeal by South Carolina Electric & Gas Company (SCE&G) of several terms of a 401 Water Quality Certification issued on February 19, 2007, by South Carolina Department of Health and Environmental Control (DHEC) for SCE&G’s Cope Station in Orangeburg County, South Carolina.

The parties have agreed to resolve this case by DHEC’s issuance of a revised 401 Water Quality Certification and have requested that the revised 401 Water Quality Certification be adopted as the order of this court.

The Court has reviewed the revised 401 Water Quality Certification and has concluded that it is appropriate to adopt the revised 401 Water Quality Certification as the Court’s Order in this case.

The revised 401 Water Quality Certification is attached hereto and made part and parcel hereof.

NOW THEREFORE, upon the joint motion and consent of the parties, this case is hereby dismissed with prejudice except as to enforcement of the terms of the 401 Water Quality Certification attached hereto.

AND IT IS SO ORDERED.
