ORDER OF DISMISSAL

THIS MATTER COMES before me at the request of the Petitioner, Girl Scouts, Central Savannah River Council, Lake Trenton Property Owners Association and Courtney Road Residents' Association which, with the consent of the Respondents South Carolina Department of Health and Environmental Control and Rodney Cato Broiler Farm, moves for a voluntary dismissal of the above-captioned contested case. By an email that was received on February 18, 2008, the Court was notified that the Respondent Rodney Cato Broiler Farm no longer wishes to have a permit to construct a poultry farm and consents to its being rescinded by the Department. Based on good cause shown,

IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that, pursuant to Rule 41(a)(2) of the South Carolina Rules of Civil Procedure, with the consent of all parties hereto, this action, including all claims herein asserted by all parties, is hereby dismissed. That previous Orders of the Court filed December 13, 2007 and February 5, 2008 which set this matter for a merits and motion hearing are vacated.

 

AND IT IS SO ORDERED.
