ORDERS:
ORDER OF DISMISSAL WITH LEAVE TO RESTORE
The Administrative Law Court is informed that the South Carolina Department of Revenue has yet
to issue a Department Determination in the above-captioned case, and the
parties have requested that the case be dismissed without prejudice with leave
to restore. In the event the Petitioner determines it necessary to re-file its
request for a contested case hearing in this matter after its receipt of the
Department’s Determination, the filing fee for the subsequent action will be
waived provided the re-filing occurs within six (6) months of the date of this
order.
THEREFORE,
this matter is DISMISSED, WITHOUT PREJUDICE upon the terms
stated above.
AND
IT IS SO ORDERED.
