ORDERS:
CONSENT ORDER OF DISMISSAL
This case arises from a Request for Contested Case Hearing filed by Linda Goldman, Goldman Cattle Truck Wash (hereinafter, “Petitioner” or “Goldman”), as a result of the issuance by the South Carolina Department of Health and Environmental Control (hereinafter, “Respondent” or “Department”) of Administrative Order 05-084-W against Goldman. On February 9, 2006, this Court issued an Order Granting Partial Summary Judgment to the Department, which granted summary judgment as to the issue of assessed penalties, the requirements ordered in Administrative Order 05-084-W, and to all conclusions of law except for the issue of whether or not Petitioner failed to provide 120 days of storage capacity in the lagoon. On February 27, 2006, the parties filed a Joint Motion for Continuance due to Petitioner’s filing of Chapter 13 bankruptcy.
The parties hereby agree that further proceedings in this matter are unnecessary as the remaining issue in the case has been rendered moot as a result of the bankruptcy.
AND IT IS SO ORDERED.
