ORDERS:
CONSENT ORDER OF DISMISSAL
This
matter comes before the South Carolina Administrative Law Court pursuant to a
request for contested case hearing filed by Petitioner, Grant Allendale, Inc., regarding
the Department of Health and Environmental Control’s denial of a Routine
Control Device Maintenance Exemption (RCDME). By Motion for Agreed Dismissal
filed on September 26, 2007, both parties have indicated that they agree to
dismiss this matter by voluntary nonsuit pursuant to Rule 41(a)(1), SCRCP and
ALC Rule 68.
Therefore, IT IS HEREBY ORDERED that the parties’ motion is GRANTED the
above-captioned case is DISMISSED.
AND
IT IS SO ORDERED.
