ORDERS:
ORDER OF DISMISSAL
This
matter is before the South Carolina Administrative Law Court (“ALC” or “Court”)
for a contested case hearing upon the request of Petitioner filed October 22,
2007. An expedited hearing on the merits of this matter was scheduled to begin
on Thursday, December 6, 2007 at 2:00 p.m. at the Administrative Law Court.
The
“Department Determination” dated October 18, 2007 indicated that the South
Carolina Department of Revenue (“SCDOR” or “Department”) received a timely
protest from Bradford M. Yanda on September 19, 2007. The Department further
stated that “Other than the question of the suitability of the location as
stated in the public protest, the Department has found that the Applicant has
met all other statutory requirements for licensure.”
On
December 3, 2007, Bradford M. Yanda, the sole Protestant in this matter, filed
a letter with the Court indicating that he would be withdrawing his protest.
Accordingly, based on the fact that the Department would have issued Petitioner’s
retail liquor license but for the timely filed public protest, and based on the
fact that the sole Protestant in this case withdrew his protest,
IT
IS THEREFORE ORDERED that the above-captioned case is hereby DISMISSED
WITH PREJUDICE.
IT
IS FURTHER ORDERED that the South Carolina Department of Revenue continue
processing Petitioner’s application for a retail liquor license for its
location at 2000 Highway 160 West, Suite 107, Fort Mill, South Carolina.
AND
IT IS SO ORDERED.
