ORDERS:
ORDER OF DISMISSAL
This matter is before me on the appeal of Samuel Michael Raybould (Appellant), filed on September 21, 2007. On October 23, 2007, the Department of Motor Vehicles filed a Motion to Dismiss this case pursuant to ALC Rule 33, which states that an Appellant must serve a copy of the Notice of Appeal on each party within thirty days of receipt of the decision from which the appeal is taken.
Pursuant to ALC Rule 62, an Administrative Law Judge may dismiss an appeal for failure to comply with the rules of procedure for appeals or for failure to comply with any time limits set forth in an appeal. As of the date of this Order of Dismissal, Appellant has not responded to the Department’s Motion or requested any additional time in which to respond. Furthermore, Appellant’s certificate of service does not indicate that a copy of his Notice of Appeal was served on the Respondent. Therefore,
IT IS THEREFORE ORDERED that this appeal is DISMISSED.
AND IT IS SO ORDERED.
