ORDERS:
ORDER OF DISMISSAL
THIS MATTER COMES before me at the request of the Petitioner, AVX Corporation,
which with the consent of the Respondent, South Carolina Department of Health and Environmental Control, moves for a voluntary dismissal of the above-captioned contested case. By letter dated April 9, 2007, the Court was notified that the Petitioner withdrew his request for a contested case hearing. Based on good cause shown,
IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that, pursuant to Rule 41(a)(2) of the South Carolina Rules of Civil Procedure, with the consent of all parties hereto, this action, including all claims herein asserted by all parties, is hereby dismissed. That previous Order of the Court filed August 27, 2007, which ordered that the parties produce Pre-hearing Statements, is vacated.
AND IT IS SO ORDERED.
