ORDERS:
CONSENT ORDER
Petitioner and Respondent have negotiated a settlement of issues underlying this contested case, as follows:
1) The S.C. Department of Health and Environmental Control shall issue, within 10 days of the filing of this Consent Order, a Section 401 Certification and Coastal Zone Consistency determination that includes the conditions expressed in Attachment A; and
2) Both Petitioner and Respondent by moving for and consenting to the entry of this Consent Order waive their respective rights to appeal this contested case.
THEREFORE, by the consent of both parties and through the approval of this Court, this contested case is hereby settled with each party bearing its own costs.
IT IS SO ORDERED.
