ORDERS:
CONSENT ORDER OF DISMISSAL
The
Petitioner, South Carolina Law Enforcement Division (“SLED”), initiated this
matter after Respondent, William Buford, was arrested and charged with Grand
Larceny (as well as simple assault & battery). It was the intention of
Petitioner to have Respondent’s concealed weapons permit suspended immediately
by way of an emergency suspension. The necessity of the suspension is due to
Petitioner’s belief that Respondent, with a concealed weapons permit, poses an
imminent threat to the public’s health, safety, and welfare. SLED may revoke the
registration of a concealed weapons permit holder if the registered individual
has been charged with a crime which would, upon conviction, disqualify a person
for registration, pursuant to S.C. Code Ann. § 40-18-130(A)(12) (Supp. 2006).
Prior
to the hearing scheduled for Thursday, March 29, 2007, the parties reached a
resolution of the matter. It has come to the attention of Petitioner that
Respondent has mailed his concealed weapons permit in to the Office of the
South Carolina Law Enforcement Division in Columbia. This is a satisfactory
conclusion to this matter.
Accordingly,
I find the agreement to be fair and equitable and will approve such
agreement and
hereby order its adoption. This Court retains continuing jurisdiction to
enforce this Order. As Petitioner no longer requires a hearing on this matter,
I also order this matter is hereby Resolved with Prejudice.

IT IS SO ORDERED.
