ORDERS:
ORDER OF DISMISSAL
Petitioner, Carolina Eastman Division of Eastman Chemical Company, moves for a dismissal
of this contested case without prejudice on the basis that the matter has been resolved.
In its motion, Petitioner states that Respondent (DHEC) has reissued construction permit
1560-0008-EH and revised it addressing the concerns issued in the contested case petition thereby
resolving all issues. Counsel for DHEC has been informed of and consents to Petitioner's withdrawal
without prejudice of its Petition for Administrative Review filed January 23, 1997.
THEREFORE, by consent of Petitioner and Respondent, the contested case shall be dismissed
without prejudice.
AND IT IS SO ORDERED.
