ORDERS:
CONSENT ORDER
THIS MATTER comes before me for a continuation of the hearing previously commenced on
September 24, 1996.
This Court is informed that the parties have reached an agreement concerning this matter. The
Agreement is as follows:
1. That the Petitioner shall voluntarily consent to a Dismissal of this action without prejudice.
2. The Respondent shall install monitoring wells in the area in question and take actual
measurements of the water table through the wet season.
3. The Petitioner reserves the right to refile this action within twenty (20) days after the written
results of the monitoring wells are received by him.
4. The record in this matter shall be preserved for future use should the Petitioner reinstate this
action.
5. The Respondent shall conclude the monitoring well testing on or before May 1, 1997.
NOW, THEREFORE, by and with the consent of the parties as indicated by the
signatures of their respective counsel, this matter is dismissed pursuant to the conditions set out
hereinabove.
