ORDER OF DISMISSAL

This matter is before the South Carolina Administrative Law Judge Division ("Division") pursuant to a request for administrative review of South Carolina Department of Health and Environmental Control's ("DHEC") Administrative Order 99-44-HW against Petro-Chem ("Petitioner"), for an alleged violation of the South Carolina Hazardous Waste Management Act, S.C. Code Ann. Regs. 61-79 (Supp. 1996). Petitioner's request for administrative review was filed with the Division on November 9, 1999. On November 15, 1999, counsel for Petitioner filed a letter with the Division requesting withdrawal of its request for appeal of DHEC's Administrative Order 99-44-HW, on the basis that a consent agreement was reached between the parties. By virtue of Petitioner's request to withdraw its request for administrative review of DHEC's Administrative Order 99-44-HW, there appears to be no further controversy for consideration by the Division.

THEREFORE, IT IS ORDERED that the above-captioned case matter is hereby DISMISSED.

AND IT IS SO ORDERED.
