ORDER OF DISMISSAL

This matter came before me on a Motion for a Contested Case Hearing filed by Petitioner Exide Corporation, primarily seeking to enjoin DHEC from conducting a removal action upon the Westgate Trailer Park in Greer, South Carolina. Prior to this contested case hearing, I heard the Petitioner's Motion for Injunction seeking to enjoin this removal action until the contested case could be heard. I issued an Order on September 10, 1999, pursuant to the Motion for Injunction, in which I found that the appropriate forum to determine the enforcement of the Consent Order by and between the parties was the Circuit Court of South Carolina. The Petitioner then sought an injunction in Circuit Court which was granted and also which resolved the disputed issued in this case. This contested case was assigned to me by Order of the Chief Administrative Law Judge on September 8, 1999. Therefore, since the issues in this case are no longer in dispute and with the consent of both parties,

IT IS HEREBY ORDERED that this case be dismissed.

AND IT IS SO ORDERED.
