ORDERS:
FINAL ORDER AND DECISION
This case is currently pending before the Division. The case was not previously set for a hearing because the parties believed they could settle the contested issues. On December 5, 2001, counsel for the Petitioner informed the undersigned
judge that there are no outstanding technical issues raised by the challenged administrative order. Further, Petitioner stated
that the disputed penalty has been submitted as a claim in pending bankruptcy proceedings regarding the Respondent. On
December 5, 2001, counsel for Respondent informed the undersigned judge that he concurs with the information and
conclusion in the letter from Petitioner's counsel.
It appearing that the request for a contested case hearing is withdrawn, IT IS HEREBY ORDERED that this case is DISMISSED.
AND IT IS SO ORDERED.
