CONSENT ORDER OF DISMISSAL

WHEREAS the Respondent, the South Carolina Department of Health and Environmental Control, (DHEC or Department) is an agency of the State of South Carolina vested with all the powers, functions, and duties granted to the Department and its officers and agents by statute;

WHEREAS the Petitioner, Don W. Morris and Don W. Morris, d/b/a Morris Oil Company, is an individual who owns underground storage tanks as defined under the SUPERB Act, S.C. Code Ann. § 44-2-20 (Supp. 1998), in Spartanburg, Spartanburg County, South Carolina; and

WHEREAS the parties to this action have reached an agreement to dispose of this case without further proceedings;

IT IS FURTHER ORDERED AND AGREED that, in exchange for Petitioner Don Morris' timely payment of the fees assessed in this action, Respondent South Carolina Department of Health and Environmental Control shall deem Administrative Order 98-0404-UST satisfied and will not seek further enforcement of it. Inasmuch as the Order is satisfied, this case is now moot and should be, and hereby, is DISMISSED.

AND IT IS SO ORDERED.
