ORDER OF DISMISSAL

The above-entitled case is pending before the Administrative Law Judge Division. On May 11, 1999, a letter was received from Petitioner, stating that he has been "reinstated to the SUPERB Fund", and verification of his compliance was stated in a letter dated April 29, 1999, from Robert L. Hutchinson, Director, Regulatory Compliance Branch, Division of UST Management. Said letter further stated "The Department’s letter of March 30, 1999, "Notice of Intent to Deny SUPERB Access" is rescinded effective this date". There being no further controversy, Kelly D. H. Lowry, Attorney for Respondent, is in agreement that settlement has been reached, and a hearing is no longer required.

IT IS THEREFORE ORDERED that the above-captioned case is hereby dismissed.

AND IT IS SO ORDERED.
