ORDER

A hearing was held in the above matter before this tribunal on May 5, 1998. I issued a Final Order and Decision on October 29, 1998. Thereafter the Respondent, Department of Health and Environmental Control, made a Motion to Amend the Final Order to correct clerical errors in the Order. The Department requested an amendment to the Order as the Order found that the approved chicken broiler facility was an expansion of an existing facility. To the contrary, the approved facility is a new facility.

Pursuant to the Respondent's Motion, I find that the Final Order and Decision issued on October 29, 1998, incorrectly refers to an existing facility on the Respondent Carter's site. However, the incorrect finding of an existing facility does not alter my decision in this matter.

IT IS THEREFORE ORDERED that the October 29, 1998, Final Order and Decision is vacated and that the attached Order dated November 6, 1998, is entered as this Court's Final Order and Decision in this matter.
