ORDERS:
ORDER OF DISMISSAL FOR DEFAULT
On May 23, 1997, an ORDER required all parties to file Prehearing Statements within fifteen (15)
days of the date of that ORDER. A June 9, 1997, Petitioner's Motion for Extension of time in which
to file their Prehearing Statement was granted allowing the Petitioner's an extension until June 20,
1997. No Prehearing Statement was filed by the June 20, 1997 deadline.
After a Motions Conference via telephone on July 1, 1997, Petitioners were ordered to file either a
settlement agreement or a Prehearing Statement by July 3, 1997. Petitioners have again failed to
comply for a second time. (ALJD Rule 23). Under such circumstances, the Administrative Law
Judge may dismiss a contested case for a failure to comply with an interlocutory order. ALJD Rule
23.
Therefore, IT IS ORDERED that the case be and hereby is dismissed.
AND IT IS SO ORDERED.
