ORDERS:
ORDER
This is an appeal of a permit issued by S.C. Department of Health and Environmental
Control, through its Office of Ocean and Coastal Resource Management, P/N #96-1W-300-P, to
DeBordieu Colony Community Association for the construction of five sheetpile groins and the
placement of sand on the beach in DeBordieu Colony, near the town of Georgetown, South
Carolina.
A pre-trial conference was scheduled in this matter for Wednesday, June 25, 1997. On
the day prior to this conference, this court was advised that all parties to this action had reached a
settlement. The terms of the settlement as agreed to by all parties are that the permit issued to
DeBordieu Colony Community Association be modified, by way of this Consent Order, to delete
all authorization by the permit for the construction of five sheetpile groins on the beach at
DeBordieu Colony. The provisions of the permit which allow for the placement of sand, to
nourish the beach, will remain.
Therefore, based on the consent of all parties as evidenced by their signatures below, P/N
#96-1W-300-P is hereby modified to delete all authorization for construction of groins, but to
allow for the placement of sand on the beach in accordance with the terms of the permit.
Nothing in this consent order shall be construed as prohibiting DeBordieu Colony Community
Association from making future applications for the construction of groins, or as prohibiting the
Petitioners from challenging or appealing future applications for the construction of groins.
AND IT IS SO ORDERED.
