ORDER OF CONSOLIDATION

This matter is before me pursuant to Respondent, South Carolina Department of Health and Environmental Control's ("DHEC") Motion to Consolidate the above referenced cases. DHEC moves to consolidate two appeals of State Land Application Permit No. ND0074713, issued to Dorchester County Public Works on January 31, 1997, to construct and operate the Upper Dorchester County Wastewater Treatment facility. South Carolina Coastal Conservation League and the other named petitioners challenge the permit for a number of reasons including that the facility will be constructed and operated in a manner to prevent any adverse effect on the quality of groundwater and nearby surface waters. Ronnie F. Judy challenges the permit on the basis that improper installation of piezometer wells has resulted in accurate readings at the proposed facility. Both appeals challenge various aspects of the same permit and request that the permit be denied. DHEC asserts that a hearing on each of these matters will result in a duplication of witness testimony and exhibits. The same witnesses would testify in both matters and the same relief is requested in each matter.

Pursuant to Rule 42(a) of the South Carolina Rules of Civil Procedure, judicial economy dictates that the matters be consolidated into one contested case. Therefore, it is hereby

ORDERED, that the Motion to Consolidate is GRANTED.

AND IT IS SO ORDERED.
