CONSENT ORDER OF DISMISSAL

THE PARTIES, by way of mutual consent and agreement, hereby move before this Court to approve the following agreement as a condition for dismissal of this action. The Parties agree to and the Court hereby approves the following agreement:

 

1. Pawleys Island Golf Club will reduce and limit wetland impacts to 0.75 acre.

 

2. The Golf Club property shall be placed under recorded Restrictive Covenants, attached to the Settlement Agreement and marked as Exhibit 2, which will protect the remainder of the wetlands on the property, and all areas that will become jurisdictional wetlands as a result of the re-development of the golf course.

 

The Court, having reviewed the agreement, hereby makes it the Order of this Court.

 

This case is hereby dismissed, except that the Court shall retain jurisdiction over this matter for the purpose of resolving any problems or disputes arising out of the finalization of the settlement agreement and restrictive covenants.

 

AND IT IS SO ORDERED.
