ORDERS:
ORDER OF CONSOLIDATION
The above-captioned contested cases are pending before the Administrative Law Judge Division.
Both of the contested cases involve the appeal of the issuance of Construction Permit #18,
017-AG to Ben Draft for proposed broiler facility and include the same parties and the same or
similar issues.
By Motion dated January 17, 1996, the South Carolina Department of Health and Environmental
Control moved to consolidate the cases.
Without objection, and in the interest of justice, the above-captioned cases bearing Docket
Numbers 95-ALJ-07-0791-CC and 96-ALJ-07-0022-CC are hereby consolidated for hearing
purposes. Each case shall retain, however, its separate caption and docket number. Further,
discovery limitations set forth in ALJD Rule 21 shall apply separately to each case.
AND IT IS SO ORDERED.
