ORDER OF DISMISSAL

The above-captioned matter was filed with the Administrative Law Court on June 30, 2004. On July 9, 2004, this office received an agreement signed by W. Lee Hewitt, III, the Protestant in this matter, and the Petitioner, which set forth that they have agreed to the following conditions being placed on the Petitioner’s permit:

1.The hours of operation will be from 11:00 a.m. until 10:00 p.m.;

2.This permit is for beer and wine service at tables only with meals; and

3.No outside music or trash will be allowed.


Based on these terms in which the Petitioner and the Protestant entered into a signed written agreement attached hereto, the Protestant set forth that he was withdrawing his protest in this case. Therefore,

IT IS HEREBY ORDERED that this matter is dismissed.

AND IT IS SO ORDERED.
