ORDERS:
ORDER OF DISMISSAL
At the May 20, 2004 hearing of the above-captioned matter, the parties and protestant in this
case agreed to a settlement of the case, and the terms of the settlement were read into the record in
open court at that hearing. The settlement consists of six stipulations to be placed on the permit
sought by Petitioner that address the concerns of Respondent South Carolina Department of Revenue
and Protestant Greenwood Police Department, both of whom withdrew their objections to the granting
of Petitioner’s permit upon acceptance of the stipulations. These settlement terms resolve all matters
in dispute in this case, and, pursuant to Rule 43(k), SCRCP, as applied under ALC Rule 68, these
terms are binding upon the parties. Therefore, as there are no justiciable issues remaining in
controversy,
IT IS HEREBY ORDERED that, pursuant to the settlement reached by the parties and the
protestant, the above-captioned matter is DISMISSED with prejudice.
AND IT IS SO ORDERED.
