ORDERS:
ORDER OF DISMISSAL
Petitioner applied for and was granted Air Permit No. 0200-0093 for its facility. The permit
imposed, certain conditions in which Petitioner opposes, stating the Department does not have the
authority to impose the conditions by which it did when granting the permit. This action is the
result of such opposition by Petitioner. Petitioner and Respondent have resolved, in principle, the
matters which led to the initiation of the present Contested Case.
THEREFORE, upon motion of the Respondent, by and with the consent of the Petitioner, this
Contested Case is hereby dismissed without prejudice.
IT IS SO ORDERED.
