CONSENT ORDER

COMES NOW Petitioner Eliskim, Inc. ("Eliskim"), by its attorneys Ogletree, Deakins, Nash, Smoak & Stewart, L.L.P. and Thorp, Reed and Armstrong, and Respondent South Carolina Department of Health and Environmental Control (the "Department"), by its attorney Samuel L. Finklea, III, and announce to the Court that the matters and things in controversy have been settled and that Eliskim's Petition appealing NPDES Permit No. SC 0047210 (the "Permit") may be dismissed.

The Petitioner and Respondent further announce that they have agreed that (1) Sections 9,10 and 11 of Part III of the Permit shall be amended or modified by Respondent as indicated in Exhibit "A" attached hereto and (2) the Permit shall be issued as of the date this Order is signed by the Court and shall expire five (5) years from such date.

IT IS SO ORDERED.
