ORDERS:
ORDER OF DISMISSAL
This matter was pending before the Administrative Law Judge Division on the petition of
Amerada Hess Corporation for review of the NPDES Permit issued by the South Carolina
Department of Health and Environmental Control allowing Amerada Hess to discharge wastewater
from its facility on Old Union Road in Spartanburg , South Carolina. Amerada Hess requests review
of the sampling and analytical requirements in NPDES Permit #SC0002895. The Petitioner pursued
other alternative possibilities for discharge and engaged in discussions with the Department regarding
the alternate plans.
As a result of those discussions, the parties reached an agreement and the Department has
issued a modified permit which shall become effective on July 1, 1995. Based upon the issuance of
the new permit, the issues raised in this petition are resolved. Therefore it is
ORDERED based upon the foregoing, this matter is hereby DISMISSED.
AND IT IS SO ORDERED.
