ORDERS:
ORDER OF DISMISSAL
THIS MATTER COMES before me at the request of the Petitioner, South Carolina
Department of Revenue (Department) which moves for a voluntary dismissal of the above-captioned contested case. By letter dated June 9, 2004, the Court was notified that the
Respondent had made repairs to his licensed location and satisfied the concerns of the
Department. The letter included a withdrawal of the Department’s Notice of Intent to Revoke
and a request for a dismissal. Based on good cause shown,
IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that, pursuant to
Rule 41(a)(2) of the South Carolina Rules of Civil Procedure, this action, including all claims
herein asserted by all parties, is hereby dismissed, with each party to bear its own attorneys’ fees
and costs.
AND IT IS SO ORDERED.
