ORDERS:
ORDER OF REMAND
This matter is before the Administrative Law Judge Court (“Court”) pursuant to the appeal
of Tony Addison, an inmate incarcerated with the Department of Corrections (“Department”). On
November 19, 2003, Addison filed a grievance challenging his July 25, 2003 conviction of Striking
an Employee With/Without a Weapon, 1.03. Addison received the Department’s final decision on
November 13, 2003. Addison filed his appeal with the Court on November 19, 2003.
On June 10, 2004, the Department filed a Motion for Remand, stating that during its review
and investigation of Addison’s claim it discovered that one of the accusing officers involved with
the underlying offense provided the warden’s response to Addison’s Step 1 grievance. In order that
Addison’s Step 1 receives all due consideration, the Department requested that the case be remanded
so Addison may re-grieve his conviction of July 25, 2003. Accordingly,
IT IS HEREBY ORDERED that this matter is remanded to the Department with
instructions that the Department allow Addison to re-grieve his conviction of July 25, 2003. In light
of this Order of Remand, the Department’s Motion to Enlarge Time, filed January 12, 2004, is
denied.
AND IT IS SO ORDERED.
