ORDER OF DISMISSAL

The above-captioned contested case regarding the issuance of an on-premises beer and wine permit and sale and consumption license was filed with the Administrative Law Court (Court) on May 14, 2004. On June 16, 2004, Jerry B. Massey, the sole Protestant in this matter, filed a letter with the Court in which he set forth he was withdrawing his protest. The Department of Revenue (Department) was excused from appearing at the hearing or participating in this proceeding pursuant to my Order dated May 21, 2004, as the Department would have issued the Petitioner’s permit and license but for the protest of Mr. Massey. Therefore,

IT IS HEREBY ORDERED that this matter is dismissed with prejudice.

IT IS FURTHER ORDERED that the Department resume processing the Petitioner’s application in this matter.

AND IT IS SO ORDERED.
