ORDERS:
CONSENT ORDER OF DISMISSAL
This matter is before the Administrative Law Judge Division on Petitioner's request for a contested case hearing to
challenge Administrative Order No. 02-069-DW issued by Respondent South Carolina Department of Health and
Environmental Control. Prior to the scheduled hearing date, the parties reached a settlement of this matter agreeing to
voluntarily dismiss the case upon the condition that Petitioner pay the Department a civil penalty in the amount of $6,000.
The parties have further agreed that the total penalty may be paid in four quarterly installments of $1500 each with the first
payment due thirty days after this Order is filed with the Administrative Law Judge Division. Each quarterly installment is
due ninety days after the last payment until the balance is paid.
