ORDER GRANTING EXTENSION OF ABEYANCE

On July 26, 2002, a letter was received from W. Michael Duncan, Attorney for Petitioner wherein he stated that Petitioner has contracted with a Rock Hill company, Katawba Environmental, Inc. to install a monitoring well for less than half the cost to be charged by the Monroe, N.C. company, Resolve. Based upon the information provided, Petitioner is requesting an extension of abeyance until August 24, 2002, at which time the test results will be completed, and report submitted. Respondent has no objection to the extension..



For good cause shown, IT IS HEREBY ORDERED that Petitioner's request for extension of the Order of Abeyance is hereby granted until August 26, 2002, at which time, Petitioner shall notify the Administrative Law Judge Division of the status of this case, and a decision will be made on whether this case shall be set for hearing or otherwise in another manner consistent with the ends of justice.



AND IT IS SO ORDERED.
