ORDERS:
ORDER OF DISMISSAL
This matter is before the Administrative Law Judge Division pursuant to the Agency Transmittal Form received on
November 1, 2001. Petitioner is appealing all permits issued by the South Carolina Department of Health and
Environmental Control to the South Carolina Electric and Gas Company for the Saluda Dam Remediation Project.
By consent order dated December 10, 2001, Petitioner agreed to "withdraw his appeal of the permits issued to SCE&G for
the Saluda Dam Remediation Project."
Furthermore, on November 5, 2001, the Clerk's Office sent a Memorandum to Petitioner providing, "In order to process
your case and have it assigned to an administrative law judge, you must file the applicable $70.00 filing fee made payable
to the Administrative Law Judge Division or request a waiver, within 10 days of the date of this Memorandum." Petitioner
failed to submit the filing fee or the request for a waiver within the specified time period.
IT IS HEREBY ORDERED that whereas Petitioner agreed to withdraw his request for a hearing in this case and also
failed to submit the filing fee, this case is dismissed.
AND IT IS SO ORDERED.
