ORDER OF DISMISSAL
By letter dated February 26, 2002, Roy Hemphill, attorney for Respondent Cokebury Development, Inc., notified this
tribunal that the above captioned matter has been settled by a compromise agreement to the satisfaction of all parties. This
letter was accompanied by a proposed Consent Order of Dismissal and a letter from Petitioner Dwain Simmons
withdrawing his request for a contested case hearing of this matter. Therefore, as there are no justiciable issues remaining
in controversy,
IT IS HEREBY ORDERED that the hearing scheduled for Tuesday, March 26, 2002, is CANCELED.
IT IS FURTHER ORDERED that this case is DISMISSED with prejudice.
AND IT IS SO ORDERED.
