ORDERS:
CONSENT ORDER
This matter is before the court by consent of all parties for the entry of a consent order. The matter arose
following the petitioner's appeal of condition 4 of a 401 Water Quality Certification issued to the petitioner in
conjunction with P/N 2000-1G-578-W, involving the construction of a dam and creation of a farm pond.
The parties hereto have reached a settlement agreement consistent with the provisions of R.61-101 et. seq.
It is therefore ORDERED that condition 4 of the 401 Water Quality Certification above referenced is hereby
amended to provide: "The applicant must preserve a minimum 50-foot-wide (or to the extent of the
applicant's property boundaries) undisturbed upland buffer around the pond, as proposed."
AND IT IS SO ORDERED.
