ORDERS:
ORDER OF REMAND
This matter is before me pursuant to an Administrative Order issued by the Department of Health and
Environmental Control (Department) charging that the Petitioner "failed to obtain a 'change order' prior
to performing significant alterations and/or equipment changes at several public swimming facilities." See Administrative Order 01-050-DW. After the filing of this contested case with the Administrative
Law Judge Division (Division), the Department filed a Motion for Leave to Amend Administrative
Order and a Motion to Dismiss this matter. After hearing from the parties in a conference call on these
motions on May 8, 2001, I have determined to grant the Department's motion to amend the
Administrative Order issued in this matter. Therefore, based on the foregoing and the circumstances
surrounding this case,
IT IS HEREBY ORDERED that this matter be REMANDED to the Department so that the
Administrative Order may be amended and reissued.
AND IT IS SO ORDERED.
