ORDERS:
CONSENT ORDER OF DISMISSAL
This matter is before the South Carolina Administrative Law Judge Division
("Division") pursuant to Petitioner Senn's request for a contested case
hearing to challenge the Department of Health and Environmental Control's
proposed decision to issue a Water Quality Certification under Section
401 of the Clean Water Act, 33 U.S.C. § 1251 et seq., to Respondent
Cornerstone in connection with its plans to construct a dam and road crossing
within the Mabry Park Subdivision of York County, South Carolina.
Prior to a hearing being held in the Division, Respondent Cornerstone
withdrew its application for a Water Quality Certification, rendering this
appeal moot.
Accordingly, by and with the consent of the parties, it is ordered and
agreed that this contested case be dismissed.
AND IT IS SO ORDERED.
