The parties hereto, by and through their undersigned attorneys, hereby agree that the navigable waters permit, the 401 Water Quality
Certification, and coastal zone consistency certification issued to Rivergate Partners, LLC, identified as P/N 1997-1X-227-P(1), dated
March 2, 2000, is hereby amended so that condition no. 2 of the permit will read:
(2) The dredging of material must not exceed the level of the original canal bottom, nad in no event shall any portion of the
completed canal exceed the depth of minus four feet mean low water.
In all other particulars the terms and conditions of P/N 1997-1X-227-P(1) will remain the same and in full force and effect.
