ORDERS:

ORDER OF DISMISSAL

This matter came before the ALJ Division on appeal from Shealy Environmental Laboratories challenging the staff decision to decertify Shealy's laboratory for four toxicity tests. The parties have reached an agreement which resolves the issues in this matter and move for dismissal of the appeal. Therefore, upon good cause shown and with the consent of the parties, this matter is dismissed on the following conditions:

1. Upon payment of the required fee, DHEC will issue final certification #32566 to Shealy for acute and chronic toxicity testing using Ceriodaphnia dubia at the new facility.

2. So much of the July 19, 2000, staff decision as may be read to revoke Shealy's certification #32010 at the Vantage Point Road Facility for acute and chronic toxicity testing using Mysodopsis bahia is rescinded, certification # 32010 remaining in full force and effect for those two tests.

AND IT IS SO ORDERED.
