ORDER OF DISMISSAL

This matter is before the Administrative Law Judge Division ("Division") pursuant to Petitioner's request for a hearing regarding the granting of NPDES Permit No. SC0040525. On September 29, 2000, Petitioner withdrew his appeal of the granting of the permit.

On September 27, 2000, the Home Builders Association of Greenville filed a Motion for Leave to Intervene. The Home Builders Association wanted to represent its own interests and requested the undersigned uphold the granting of the permit. Because Petitioner withdrew his petition for a hearing, however, the granting of the permit is no longer being challenged. Accordingly the Home Builders Association's Motion for Leave to Intervene is moot.

IT IS THEREFORE ORDERED that this case is dismissed with prejudice.

AND IT IS SO ORDERED.
