ORDERS:
CONSENT ORDER OF DISMISSAL
This matter is before the Administrative Law Judge Division by way of the motion of Macalloy Corporation ("Macalloy"), the
Petitioner, for dismissal of this action. The Respondent, South Carolina Department of Health and Environmental Control ("the
Dpartment"), has consented to the dismissal of this action. Macalloy and the Department have entered into a Settlement Agreement,
dated September 15, 2000, by which they have resolved the outstanding issues in this contested case proceeding. Section 9 of that
Settlement Agreement provides for the incorporation of the Settlement Agreement into this Order.
WHEREFORE, upon the motion of Macalloy Corporation, to which the South Carolina Department of Health and Environmental
Control has duly consented, the Settlement Agreement, dated September 15, 2000, which is attached to this Order and incorporated in
it by reference, is hereby approved, and this action is hereby dismissed.
IT IS SO ORDERED.
