ORDERS:
CONSENT ORDER OF DISMISSAL
This contested case comes before the undersigned by way of an agency transmittal from the South Carolina Department of Health and
Environmental Control ("DHEC") directing the conduct of a hearing due to the appeal by Petitioner Harry Ives and Harry Ives d/b/a
The General Store of the issuance of Administrative Order 99-0266-UST. Prior to a hearing being held, the parties have reached an
agreement which will resolve this matter without the need for a hearing.
Specifically, Petitioner has agreed to the following:
1. Petitioner has agreed to perform a Tier I Assessment, also known as a Standard Limited
Assessment, as defined in DHEC's Tier I Assessment Guidelines issued March 15, 2000,
at his site referenced in Administrative Order 99-0266-UST.
2. Petitioner has agreed to pay a civil penalty of $2000.
Accordingly, by and with the consent of the parties, it is ordered and agreed that this contested case is dismissed.
IT IS SO ORDERED.
