ORDER

In the above-referenced matter, a regulatory hearing was scheduled for Thursday, March 30, 2000 at 9:30 a.m. at the Administrative Law Judge Division hearing room, Edgar A. Brown Building, 1205 Pendleton Street, Columbia, South Carolina.

ALJD Rule 45 requires the agency to provide a statement, at least ten (10) days before the scheduled hearing date, confirming the need for a hearing pursuant to S.C. Code Ann. § 1-23-110 (Supp. 1994) on the basis that a request was made by twenty-five (25) persons, a governmental subdivision or agency, or an association having not less than twenty-five (25) members. In this matter, the Department of Insurance published in the December 24, 1999 State Register that March 30, 2000 was both the deadline for comments and the hearing date. Consequently, the Department of Insurance could not provide the Rule 45 statement of need and reasonableness until the time of the hearing.

At the hearing on March 30, the Department of Insurance advised the Administrative Law Judge Division that a hearing was not necessary, as no requests for a hearing were submitted to the agency.

IT IS THEREFORE ORDERED that this matter is hereby dismissed.

AND IT IS SO ORDERED.
