ORDERS:
ORDER OF DISMISSAL
This matter was pending before the South Carolina Administrative Law Judge Division
("Division") upon the request of The South Carolina Department of Insurance ("Proponent").
Proponent's request for a public hearing was filed pursuant to S.C. Code Ann. § 1-23-110(3) (Supp.
1998). The scheduled hearing was in reference to the promulgation of proposed regulations to
amend Regulation 69-46: "Medicare Supplement Insurance." Proponent asserts that the amendment
is required in order for the State to comply with the Balanced Budget Act of 1997, and to maintain
federal approval of South Carolina's Medicare Supplement Insurance program.
Pursuant to a letter dated February 22, 1999, and filed with the Division on February 26, 1999
by counsel for Proponent, no hearing requests were received. In accordance with S.C. Code Ann.
§ 1-23-110 (Supp. 1998), a public hearing is not required because there has been no request for such
by twenty-five (25) persons, a governmental subdivision or agency, or by an association having at
least twenty-five (25) members.
IT IS THEREFORE ORDERED that the hearing scheduled for Wednesday, March 3, 1999,
at 2:00 p.m. is CANCELED, and this matter is DISMISSED.
AND IT IS SO ORDERED.
