ORDER OF DISMISSAL

This matter was pending before the South Carolina Administrative Law Judge Division ("Division") upon the request of The South Carolina Department of Labor, Licensing, and Regulation, Office of Amusement Ride Safety ("Proponent"). Proponent's request for a public hearing was filed pursuant to S.C. Code Ann. § 1-23-110(3) (Supp. 1997). The scheduled hearing was in reference to the promulgation of proposed regulations to amend the South Carolina Amusement Ride Safety Code Regulations, by updating the definition of "serious injury."

Pursuant to a letter dated January 26, 1999, and filed with the Division by counsel for Proponent, no hearing requests were received. In accordance with S.C. Code Ann. § 1-23-110, a public hearing is not required because there has been no request for such by twenty-five (25) persons, a governmental subdivision or agency, or by an association having at least twenty-five (25) members.

THEREFORE, the hearing scheduled for Tuesday, February 9, 1999 at 3:00 p.m. is CANCELED, and this matter is DISMISSED.

AND IT IS SO ORDERED.
