ORDERS:
FINAL ORDER AND DECISION (Proposed Regulation)
This matter was pending before the South Carolina Administrative Law Judge Division
("Division") upon the request of the South Carolina Department of Revenue ("Proponent") for a
public hearing pursuant to S.C. Code Ann. §§ 1-23-110 and 1-23-111 (Supp. 1997) on the
promulgation of a regulation to establish the requirements for the sale by a hotel, motel, or inn of
alcoholic beverages (liquor, beer, wine) by means of hospitality cabinets (S.C. Code Ann. §§ 61-6-2300 through 61-6-2370) (Supp. 1997).
In a letter dated, October 2, 1998, counsel for Proponent notified the Division that no hearing
request was made. In accordance with S.C. Code Ann. § 1-23-110, a public hearing is not required
because there has been no request by twenty-five (25) persons, a governmental subdivision or
agency, or by an association have at least twenty-five (25) members.
THEREFORE, the hearing scheduled for Monday, October 19, 1998 at 9:30 a.m. is
CANCELED.
AND IT IS SO ORDERED.
