ORDER

In the above-referenced matter, a regulatory hearing was scheduled for Thursday, February 6, 1997 at 10:00 a.m. at the Administrative Law Judge Division hearing room, Edgar A. Brown Building, 1205 Pendleton Street, Columbia, South Carolina.

ALJD Rule 45 requires the agency to provide a statement, at least ten (10) days before the scheduled hearing date, confirming the need for a hearing pursuant to S.C. Code Ann. § 1-23-110 (Supp. 1995) on the basis that a request was made by twenty-five (25) persons, a governmental subdivision or agency, or an association having not less than twenty-five (25) members.

The Department advised the Administrative Law Judge Division, by letter dated January 28, 1997, that a hearing is not necessary as no requests for a hearing were submitted to the agency.

IT IS THEREFORE ORDERED that the hearing scheduled for February 6, 1997, at 10:00 a.m. is hereby canceled.

AND IT IS SO ORDERED.
