ORDER

In the above-referenced matter, a regulatory hearing was scheduled for Monday, January 6, 1997 at 10:00 a.m. at the Administrative Law Judge Division hearing room, Edgar A. Brown Building, 1205 Pendleton Street, Columbia, South Carolina.

ALJD Rule 45 requires the agency to provide a statement, at least ten (10) days before the scheduled hearing date, confirming the need for a hearing pursuant to S.C. Code Ann. § 1-23-110 (Supp. 1995) on the basis that a request was made by twenty-five (25) persons, a governmental subdivision or agency, or an association having not less than twenty-five (25) members. ALJD Rule 45 also requires that certain documents be prefiled at least ten (10) days before the hearing date.

The department advised the Administrative Law Judge Division, by letter dated December 23, 1996, that a hearing is not necessary as no requests for a hearing were submitted to the agency.

IT IS THEREFORE ORDERED that the hearing scheduled for January 6, 1997, at 10:00 a.m. is hereby canceled.

AND IT IS SO ORDERED.
